Depending on how an employee is classified, federal and state laws may require certain employment benefits, such as workers’ compensation, unemployment compensation, unpaid family and medical leave, and military leave. The Fair Labor Standards Act further classifies employees as eligible or ineligible for overtime pay and refers to them as either being exempt or non-exempt from the Act’s provisions. When determining employee classification it is not sufficient to just use the eligibility requirements under their insurance benefit plans, and getting it wrong can lead to significant claims and litigation against any employer. The Employee Credit Privacy Act takes effect January 1, 2011 and provides that an employer may not “fail or refuse to hire or recruit, discharge, or otherwise discriminate against an individual with respect to employment, compensation, or a term, condition, or privilege of employment because of the individual's credit history or credit report.” This teleseminar will explore what this provision means for businesses and how companies can get themselves into trouble. The program will consider the extent to which employers can inquire about an applicant's or employee's credit history; or order or obtain an applicant's or employee's credit report from a consumer reporting agency; as well as the extent the Act will apply when a satisfactory credit history relates to a bona fide occupational requirement.
